Terms of Service

1. Purpose
These Terms of Service ("Terms") govern the access and use of the Cosmos Darkroom platform (hereinafter "the Service"), published by Sébastien Voerman (hereinafter "the Publisher"). The Service is a SaaS (Software as a Service) platform for AI-powered astrophotography image processing, accessible via web browser.
The Service's technical infrastructure is operated by the Publisher on infrastructure located in France. The Service does not offer any professional-grade availability guarantee (SLA). The User is hereby informed and expressly accepts this by using the Service.
2. Acceptance of Terms
By creating an account, subscribing to a plan, or using the Service in any way, you ("the User") declare that you have read, understood, and accepted these Terms in their entirety. If you do not accept these Terms, you must not use the Service.
Use of the Service constitutes full and unconditional acceptance of the Terms in effect at the time of use.
3. Service Description
Cosmos Darkroom offers an automated astrophotography image processing service including:
- 16-step AI processing pipeline
- Deep learning noise reduction
- Light pollution and gradient removal
- Smart star control
- Real-time image editor with 15+ adjustments
- Export in various formats (JPEG, PNG, 16-bit TIFF)
- Night sky observation planner ("Tonight")
- Community gallery (Cosmos Feed / Cosmos Gallery)
- 3D parallax animation video generation from processed images
The Service is an image processing and editing tool. It is in no way a data hosting service.
The sole purpose of the Service is to allow the User to submit astrophotography images for automated processing, in exchange for processing credits.The Publisher does not provide any hosting, persistent storage, backup, continuous file availability, or any service other than image processing.
4. Nature of SaaS Service — Availability
Important: Cosmos Darkroom is an online service (SaaS) that depends on complex technical infrastructure including servers, internet connections, GPUs, and third-party services (NextAuth for authentication, Stripe for payment).
The Service relies on technical infrastructure that may be subject to interruptions. The User acknowledges and accepts that the Service offers no availability guarantee (SLA).
By subscribing, you acquire a defined number of monthly processing credits and access to the features associated with your plan. You do not acquire a right to continuous, uninterrupted access to the Service 24 hours a day, 7 days a week.
Consequently:
- The Service may be temporarily unavailable for maintenance, updates, or technical issues, without prior notice
- We do not guarantee any specific availability rate (SLA)
- Interruptions may occur due to network failures, server outages, power cuts, or any other force majeure event
- The Service requires a stable internet connection on your end to function
- In case of temporary Service unavailability, no compensation, refund, or subscription extension shall be due
We commit to making our best efforts to keep the Service accessible, but we cannot be held liable for any interruption, regardless of its cause or duration.
5. Subscriptions, Credits, and Billing
Subscriptions are offered as monthly plans (Free, Hobby, Pro). Each plan includes a defined number of image processing credits per month. Payments are processed securely by Stripe.
5.1 Subscription Scope
Your subscription entitles you to a monthly quota of image processing credits and access to your plan's features. A subscription is not a guarantee of permanent and uninterrupted access to the Service (see Section 4).
5.2 Right of Withdrawal
Pursuant to Article L. 221-28 of the French Consumer Code (and Directive 2011/83/EU Art. 16(m)), the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium where performance has begun with the consumer's prior express consent and acknowledgment of loss of right of withdrawal. By using your processing credits, you acknowledge that performance of the service has begun and expressly waive your right of withdrawal for consumed credits.
5.3 No Subscription Refunds
All subscriptions are final. No refund, even partial, shall be granted for a current subscription period, for any reason whatsoever (dissatisfaction, unused credits, temporary Service unavailability, change of mind, etc.).
You may cancel your subscription at any time from your account settings or via the Stripe portal. Cancellation takes effect at the end of the current billing period: you retain access to the Service and your remaining credits until that date. No pro-rata refund will be issued.
5.4 Non-Cumulative Credits
Processing credits are allocated monthly and do not roll over from one month to the next. Unused credits at the end of the billing period are forfeited.
5.5 Exclusive Scope of Subscription
The subscription grants only the right to use image processing credits during the current billing period. It does not grant any right of access to the infrastructure, algorithms, AI models, source code, or any other technical component of the Service. The subscription does not constitute a contract for IT services, consulting, maintenance, or technical support.
6. Credit Refund Policy (Result Guarantee)
In the interest of transparency, Cosmos Darkroom offers a Result Guarantee on individual image processing: if you are not satisfied with the result of a specific processing, you may request a refund of the credit used for that specific processing.
This guarantee applies exclusively to the processing credit, not to the subscription itself.It does not result in any monetary refund; the credit is simply re-credited to your account.
7. Image Storage — No Hosting Guarantee
Cosmos Darkroom is not a data hosting service. We do not operate as a hosting provider under applicable law.
Images you upload and processing results are stored temporarily on our servers solely to allow you to access and download them. This storage is a complementary service provided free of charge and without any obligation of result.
Accordingly:
- We do not guarantee the preservation, permanence, or integrity of your images on our servers
- Your images may be deleted at any time, without notice, for technical, maintenance, storage capacity, or any other reason
- You are solely responsible for backing up your original files and processing results
- We disclaim all liability for loss, corruption, or deletion of images stored on our servers
- It is your responsibility to download your processing results as soon as they are available
- The Publisher reserves the right to automatically purge images and processing results after a period at its sole discretion, without prior notification. No minimum retention period is guaranteed
⚠️ Critical recommendation: Always keep a copy of your original files on your own storage devices. Never rely on Cosmos Darkroom as the sole storage location for your images.
8. Processing Quality — User Responsibility
Cosmos Darkroom is an automated AI-powered image processing service. We do not guarantee any specific result, any particular quality level, or any adequacy of the result to your subjective expectations.
The quality of processing results depends on many factors, including:
- Source image quality (resolution, signal-to-noise ratio, shooting conditions)
- Uploaded file format
- Parameters chosen by the user during upload (image type: linear/stretched, Newton mode, star size, stretch intensity, etc.)
- Editor adjustments applied (brightness, contrast, curves, levels, etc.)
You are solely responsible for the parameters and adjustments applied to your images.Incorrect settings may lead to unsatisfactory results. We cannot be held liable for results you find disappointing if they stem from inappropriate parameter choices or insufficient source image quality.
This is precisely why we offer the Result Guarantee (Section 6): if a result does not satisfy you, your credit is refunded. This guarantee constitutes your sole remedy.
9. Community Content (Cosmos Feed / Cosmos Gallery)
The Service includes a community gallery allowing users to publish their processed images, comment on, and rate other users' publications.
- You are solely responsible for the content you publish on the community gallery
- You warrant that you hold the rights to the images you publish
- By publishing content on the gallery, you grant the Publisher a non-exclusive, royalty-free, worldwide, sublicensable license to display, reproduce, and distribute such content for the purpose of operating the Service (gallery display, thumbnails, sharing). This license terminates upon deletion of the content or account
- We reserve the right to remove any content deemed inappropriate, unlawful, or contrary to public decency, without notice or justification
- Content published on the gallery is publicly visible to all Service users
- We do not guarantee the preservation of community content
10. Intellectual Property
10.1 Your images belong to you
Your images belong to you 100%. You retain all intellectual property rights over all images you upload and all processing results generated by the Service. Processing your images through Cosmos Darkroom does not grant us any ownership rights over them.
10.2 Blog publication right
By using the Service, you grant the Publisher a non-exclusive, royalty-free right to publish your processed images on the official Cosmos Darkroom blog, for the purpose of promoting the Service and showcasing the astrophotography community. This right includes publishing the processed image with your username as credit.
Right of removal: If you do not wish your image to appear on the blog, you may request its removal at any time by sending a simple email to sebastien.voerman@gmail.com. The image will be removed within a reasonable timeframe after receiving your request.
10.3 Service ownership
All Service content (interface, code, texts, logos, algorithms, AI models) is the exclusive property of the Publisher and is protected by copyright and intellectual property law.
11. Third-Party Software Components
11.1 Use of Third-Party Components
The Service may incorporate third-party software components, including StarNet v2, used exclusively for astrophotography image processing. These components remain subject to their own license terms. In the event of a conflict between these Terms and the third-party component's license terms, the third-party license terms shall prevail for the relevant scope.
11.2 Authorized Scope of Use
Features relying on StarNet v2 are provided solely for the post-processing of astronomical images (astrophotography). The User shall not use these features for any purpose outside this scope.
11.3 Prohibition of AI Training Reuse
The User shall not use, directly or indirectly, StarNet v2 components or outputs generated via these components to train, fine-tune, evaluate, or develop any machine learning model intended for image transformations, unless expressly authorized in writing by the relevant rights holder.
11.4 Technical Restrictions and Intellectual Property
The User shall not decompile, disassemble, circumvent technical protections, extract weights or models, or create derivative works from StarNet v2 components, except as strictly permitted by applicable law and the third-party license.
11.5 Non-Compliance Measures
In case of reasonable suspicion of non-compliant use under these Terms or applicable third-party licenses, the Operator may immediately suspend access to the relevant features, without prejudice to any further action.
11.6 Third-Party Component Changes
The Operator may modify, replace, suspend, or withdraw any feature dependent on a third-party component, particularly in the event of a license change, unavailability, or withdrawal of the third-party component.
11.7 Compliance Traceability
The Operator maintains internal traceability records (component version, deployment date, binary hash, technical logs) to demonstrate compliance in the operation of third-party components.
12. General Limitation of Liability
To the fullest extent permitted by applicable law, Cosmos Darkroom and its Publisher disclaim all liability for:
- Any direct, indirect, incidental, consequential, or special damages resulting from the use or inability to use the Service
- Any loss of data, images, files, or processing results
- Any Service interruption, regardless of cause or duration
- Any processing result deemed unsatisfactory by the User
- Any damage resulting from unauthorized access to your data
- Any financial loss related to use of the Service
- Any malfunction related to third-party services (NextAuth, Stripe, cloud infrastructure)
In any event, the Publisher's total aggregate liability, for all causes combined, shall be limited to the amount of the monthly subscription paid by the User at the time of the triggering event.
12.1 Indemnification
The User agrees to indemnify, defend, and hold harmless the Publisher against any claim, demand, action, damage, loss, cost, or expense (including reasonable attorney's fees) arising from or related to: (a) the User's use of the Service; (b) the User's breach of these Terms; (c) the User's violation of any third-party right; (d) content published by the User on the community gallery.
12.2 Class Action Waiver
To the fullest extent permitted by applicable law, the User waives any right to participate in a class action, group action, or any collective proceeding against the Publisher.All disputes must be resolved individually.
13. Personal Data
The processing of your personal data is described in our Privacy Policy, which forms an integral part of these Terms.
14. Termination
You may terminate your account at any time. We reserve the right to suspend or terminate your account in case of violation of these Terms, abuse of the Service, or for any other legitimate reason, without compensation.
Upon termination, regardless of cause, your images and data stored on our servers may be deleted immediately and without possibility of recovery.
15. Force Majeure
The Publisher shall not be held liable for any failure to perform its obligations resulting from a force majeure event, including but not limited to: server failure, power outage, internet network failure, hardware failure, natural disaster, pandemic, government order, cyberattack, third-party provider failure, software or hardware updates, scheduled or emergency maintenance.
16. Prohibited Uses
The User shall not:
- Use the Service for purposes other than astrophotography image processing
- Attempt to access the Publisher's systems, servers, or networks without authorization
- Engage in scraping, automated data extraction, or reverse engineering of the Service
- Use bots, scripts, or any automated means to access the Service or circumvent credit limits
- Intentionally overload the Service infrastructure (DDoS, flood, etc.)
- Attempt to exploit security flaws or vulnerabilities in the Service
- Resell, sublicense, or redistribute access to the Service or processing credits
- Use the Service to host, store, or distribute unlawful content
- Share login credentials or allow a third party to use their account
In case of violation, the Publisher reserves the right to immediately suspend or terminate the User's account, without notice, without refund, and without prejudice to any further action, including damages.
17. Modification of Terms
We reserve the right to modify these Terms at any time. Modifications shall take effect upon publication on the Service. Continued use of the Service after modification constitutes acceptance of the new Terms. For material changes, we will notify you by email or through an in-Service notification.
18. Governing Law and General Provisions
These Terms are governed by French law. Any dispute relating to the interpretation or performance of these Terms shall be submitted to the competent French courts, unless mandatory legal provisions provide otherwise.
18.1 Severability
If any provision of these Terms is declared null, illegal, or unenforceable by a competent court, the remaining provisions shall remain in full force and effect. The invalidated provision shall be replaced by a valid provision that most closely reflects the original intent.
18.2 Entire Agreement
These Terms, the Privacy Policy, and the Legal Notice constitute the entire agreement between the User and the Publisher. They supersede any prior agreement relating to the same subject matter.
18.3 No Waiver
The Publisher's failure to exercise a right or to require performance of any obligation under these Terms shall not constitute a waiver of that right or obligation.
